Terms of Service
Effective September 25, 2026
The short version. Plum records and takes notes on conversations, so you are responsible for telling people and getting their consent before you record them, as the law where you are requires. You own your content, and we only use it to run Plum for you: we never use it to train AI models. AI notes can be wrong, so check anything important. Pre-orders are fully refundable until Plum is delivered. Paid plans renew automatically until you cancel, and you can cancel online at any time. This summary isn't a substitute for the full terms below.
These Terms of Service (the "Terms") are an agreement between you and Hero Not Found, Inc. ("Hero Not Found," "we," "us"), the company that makes Plum. They cover the Plum apps, devices, website at helloplum.ai, and related services (together, "Plum" or the "Service"). Our Privacy Policy explains how we handle personal information and is part of these Terms.
By creating an account, tapping or clicking to accept, or using Plum, you agree to these Terms. If you use Plum on behalf of a company or other organization, you confirm you're authorized to accept these Terms for it, and "you" includes that organization.
1. Who can use Plum
- You must be at least 18 and able to form a binding contract.
- Plum is currently offered in the United States only.
- You're responsible for your account and for keeping your sign-in credentials secure. Tell us promptly at support@helloplum.ai if you think your account has been compromised.
- Plum is not directed to children, and you may not use it to record children except as permitted by law and with a parent's or guardian's consent.
2. Early access and beta
Plum is in development and is being released to a limited group first. During early access and beta, features may change, be interrupted, or be removed, and there is no uptime or service-level commitment. We'll give you reasonable notice and a chance to export your content before ending a beta or deleting beta data. Our privacy commitments, including the ones about AI training, apply in full during early access and beta.
3. Recording and consent
Plum listens to and transcribes conversations. Recording laws differ by state and country, and in some places, including California, everyone in a private conversation must agree before it's recorded.
You're responsible for using Plum lawfully. Before Plum captures a conversation, you agree to:
- give every notice and obtain every consent required by the laws that apply to you and to the people you record, including laws that require consent from all participants;
- follow any workplace rules and employee-monitoring notice laws that apply to you or your organization;
- stop recording, for example by pausing Plum or turning off your Plum device, if someone asks you to or doesn't consent; and
- respect the rights of people who don't use Plum, including requests to delete recordings of them.
You agree not to:
- record anyone secretly, or hide, disable, obscure, or tamper with any recording indicator in Plum's apps or devices;
- record in places where people expect heightened privacy, such as restrooms, locker rooms, or medical, legal, or counseling settings, unless everyone present has given informed consent and it's otherwise lawful;
- use Plum to identify, profile, or track people who haven't agreed to it; or
- use Plum for surveillance, harassment, or any unlawful purpose.
Plum may include features that help with notice and consent, such as recording indicators and pause controls. Those tools help, but they don't guarantee your use is lawful, and nothing in Plum is legal advice.
4. Your content
"Your Content" means the audio, transcripts, notes, and other content you capture, upload, or create with Plum, and the content Plum generates for you from it.
- You own Your Content. As between you and us, you keep all rights in it.
- We use it only to run Plum for you. You give us a limited license to host, process, transmit, and display Your Content solely to provide, secure, and support the Service for you, and as required by law. This license ends when Your Content is deleted from Plum.
- We never use Your Content to train AI models, whether ours or our providers'. We require the AI providers that process Your Content on our behalf not to train on it either. If we ever want to change this, we'll ask for your affirmative consent first, and any change will only apply going forward.
- We don't sell Your Content.
How we store, protect, retain, and delete Your Content is described in our Privacy Policy.
5. Organizations and teams
If you use Plum through an organization's workspace, that organization controls the workspace. Its administrators may manage members, set retention and consent settings, and access or delete content in the workspace, as allowed by the workspace settings. The organization is responsible for its members' use of Plum and for giving its members any notices required by law.
6. AI output
Plum uses artificial intelligence to transcribe audio, attribute speakers, and identify commitments, promises, and directions. AI output can be inaccurate, incomplete, or attributed to the wrong person. Review anything important before relying on it. Plum's output is not legal, medical, financial, or other professional advice. Don't use Plum's output as the only basis for decisions that significantly affect someone, such as hiring, firing, discipline, credit, housing, or medical care.
7. Connectors and agents
Plum lets you connect other services and AI agents (for example, through Model Context Protocol connections for tools like Claude or Codex). When you connect a third-party service or agent, you direct us to send it the content you authorize. That service's use of your data is governed by its own terms and privacy policy, not ours, and our commitments about retention and AI training don't extend to data after you send it to a service you choose. You can disconnect a connector at any time. We aren't responsible for third-party services.
8. Acceptable use
In addition to the rules in Section 3, you agree not to:
- break the law or infringe anyone's rights, including privacy and intellectual property rights;
- probe, scan, or test Plum's security, or interfere with or overload the Service;
- reverse engineer, decompile, or try to extract Plum's source code or models, except where the law allows it despite this restriction;
- copy, scrape, resell, or build a competing product from the Service or its output;
- share your account, or access Plum through automated means other than the connectors and interfaces we provide; or
- use Plum in violation of the usage policies of the AI providers we rely on, which we'll make available on request.
We may suspend or limit accounts that violate these Terms or put others at risk. Where practical, we'll tell you first and give you a chance to fix the problem.
9. Pre-orders, subscriptions, free trials, billing, and cancellation
Some Plum features require a paid subscription. Before you buy, we'll show you the plan, price, currency, billing frequency, and renewal terms, and we'll ask for your express agreement.
Pre-orders
Plum is still in development. When you pre-order, we'll show you what you're buying, the price, when you'll be charged, and our estimated delivery date.
- The features we describe are what we're building toward. We'll tell you before delivery if anything material changes.
- You can cancel a pre-order for a full refund at any time before it's delivered by emailing support@helloplum.ai or through your account.
- If we can't deliver by the estimated date, we'll tell you, give you a revised date, and offer you the choice to cancel for a full refund.
- If we don't deliver, you'll get a full refund.
- A pre-ordered subscription starts, and its billing period begins, when we make Plum available to you. From then on, the rest of this section applies.
Automatic renewal
Subscriptions renew automatically at the end of each billing period (for example, monthly or annually) at the then-current price, and your payment method is charged at each renewal until you cancel. After you subscribe, we'll email you a confirmation with your subscription terms and how to cancel. For annual plans, we'll send a reminder before renewal as the law requires.
Free trials
If you start a free trial, we'll tell you when it ends and what you'll be charged afterward. Unless you cancel before the trial ends, your subscription will begin and your payment method will be charged at the price shown when you signed up. We'll send you a reminder before a trial ends where the law requires. Specific promotions may have additional terms, which we'll show you when you sign up.
How to cancel
You can cancel online at any time from the billing section of your Plum account settings, or by emailing support@helloplum.ai. Cancellation takes effect at the end of your current billing period, and you'll keep access until then. We won't charge you again after you cancel.
Refunds
Except for pre-orders, which are refundable until delivery as described above, payments are non-refundable. We don't provide refunds or credits for partial billing periods or unused time, except where required by law or where we tell you otherwise in writing. If you think you were charged in error, contact us at support@helloplum.ai and we'll look into it.
Price changes
We'll notify you in advance of any price change, as required by law. A new price applies from your next billing period after the notice, and you can cancel before it takes effect.
Team plans
Team and organization plans are billed per seat. The organization's billing administrator is responsible for payment, and adding seats may result in prorated charges.
Payment processing and taxes
Payments on the web are processed by Stripe. We don't receive or store your full card number. By subscribing, you authorize us and Stripe to charge your payment method for the subscription and applicable taxes. Prices exclude taxes unless stated otherwise. If a payment fails, we may retry it and may suspend paid features until it succeeds.
Purchases through Apple
If you subscribe through Apple's App Store, Apple handles billing, renewals, cancellations, and refunds under its terms. Manage or cancel those subscriptions in your Apple Account settings.
10. Our intellectual property and your license to use Plum
Plum, including its software, designs, and trademarks, belongs to Hero Not Found and its licensors. Subject to these Terms, we give you a limited, non-exclusive, non-transferable, revocable license to use Plum for your own or your organization's internal purposes. If you send us suggestions or feedback, we may use them without obligation to you. Feedback doesn't include Your Content.
11. Apps downloaded from Apple
If you downloaded a Plum app from Apple's App Store, these additional terms apply:
- These Terms are between you and Hero Not Found only, not Apple. We, not Apple, are solely responsible for the app and its content.
- Your license to use the app is limited to a non-transferable license to use it on Apple-branded products that you own or control, as permitted by the Usage Rules in the Apple Media Services Terms and Conditions, except that it may be accessed by other accounts associated with you through Family Sharing or volume purchasing.
- We're solely responsible for providing maintenance and support for the app. Apple has no obligation to do so.
- We're responsible for any product warranties, whether express or implied by law, to the extent not effectively disclaimed. If the app fails to conform to an applicable warranty, you may notify Apple, and Apple will refund the purchase price for the app, if any. To the maximum extent permitted by law, Apple has no other warranty obligation with respect to the app.
- We, not Apple, are responsible for addressing any claims by you or any third party relating to the app or your possession or use of it, including product liability claims, claims that the app fails to conform to any applicable legal or regulatory requirement, and claims under consumer protection, privacy, or similar laws.
- If a third party claims that the app or your possession and use of it infringes that third party's intellectual property rights, we, not Apple, are solely responsible for the investigation, defense, settlement, and discharge of that claim.
- You confirm that you are not located in a country subject to a U.S. Government embargo or designated by the U.S. Government as a "terrorist supporting" country, and that you are not on any U.S. Government list of prohibited or restricted parties.
- Questions, complaints, or claims about the app can be sent to Hero Not Found, Inc., 2261 Market Street STE 36449, San Francisco, CA 94114, support@helloplum.ai, (415) 483-5175.
- You must comply with applicable third-party terms, such as your wireless data service agreement, when using the app.
- Apple and its subsidiaries are third-party beneficiaries of these Terms, and once you accept these Terms, Apple has the right (and is deemed to have accepted the right) to enforce them against you as a third-party beneficiary.
12. Export controls and sanctions
You may not use or export Plum in violation of U.S. export control or sanctions laws. You confirm you're not located in, or ordinarily resident in, a country or region subject to comprehensive U.S. sanctions, and that you're not a person the U.S. Government prohibits from receiving U.S. exports or services.
13. Ending your use of Plum
You can stop using Plum and delete your account at any time. We may suspend or terminate your access if you materially breach these Terms, if required by law, or if we discontinue the Service, and we'll give you notice and a chance to export Your Content where reasonably possible. When your account is deleted, we delete Your Content as described in our Privacy Policy. Sections that by their nature should survive termination will survive, including Sections 4 (as to ownership), 6, and 14 through 18.
14. Disclaimers
To the fullest extent permitted by law, Plum is provided "as is" and "as available," without warranties of any kind, whether express, implied, or statutory, including warranties of merchantability, fitness for a particular purpose, title, non-infringement, and accuracy. We don't warrant that Plum will be uninterrupted, error-free, or secure, or that AI output will be accurate. Some jurisdictions don't allow certain disclaimers, so some of these may not apply to you.
15. Limitation of liability
To the fullest extent permitted by law, neither we nor our suppliers will be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits, revenue, data, or goodwill, arising out of or related to these Terms or Plum, even if we've been advised of the possibility.
To the fullest extent permitted by law, our total liability for all claims arising out of or related to these Terms or Plum is limited to the greater of the amounts you paid us for Plum in the 12 months before the event giving rise to the claim, or $100.
These limits don't apply to liability that can't be limited by law, such as liability for fraud or for death or personal injury caused by negligence.
16. Indemnity
You'll defend, indemnify, and hold harmless Hero Not Found and its officers, employees, and agents from and against third-party claims, and the resulting losses and reasonable legal fees, arising from (a) Your Content, (b) your recording of anyone without the notice or consent required by law, or (c) your violation of these Terms or the law. We'll promptly notify you of any claim, and we may participate in the defense with counsel of our choosing.
17. Disputes and governing law
If you have a concern, please contact us first at support@helloplum.ai. Most issues can be resolved informally, and we'll try in good faith to do so within 30 days.
These Terms are governed by the laws of the State of California, without regard to its conflict-of-laws rules. Any dispute that isn't resolved informally will be heard exclusively in the state or federal courts located in San Francisco County, California, and you and we consent to their personal jurisdiction. Either party may bring an individual claim in small claims court if it qualifies.
18. Changes to these Terms
We may update these Terms from time to time. We'll post the new version here with a new effective date, and for material changes we'll give you at least 30 days' notice by email or in Plum before they take effect. If you don't agree, you can cancel before the changes take effect. Any change that would expand how we use Your Content, including for AI training, will apply only with your affirmative consent and only going forward.
19. General
These Terms, together with our Privacy Policy and any order or plan terms we show you at purchase, are the entire agreement between you and us about Plum. If any provision is found unenforceable, the rest stays in effect. Our failure to enforce a provision isn't a waiver. You may not assign these Terms without our consent; we may assign them in connection with a merger, acquisition, or sale of assets, with notice to you. Neither party is liable for delays caused by events beyond its reasonable control.
